[Indonesia] IPR Arbitration Agency to be immediately founded
 
 
Plenty disputes on Copyright has triggered government to found a particular agency to handle them. In the near future, government will establish Intellectual Property Right (IPR) Arbitration and Mediation Agency (BAM HKI), which is notably an implementation of Copyright Law regarding alternative dispute resolution (ADR) for any civil case quarrel.
 
Having met up Minister of Law and Human Rights, Patrialis Akbar, the Coordinator of BAM HKI Initiator Team, A. Zen Purba, explained that the agency would shortly be established to mediate any dispute over IPR ownership.
 
The concern of establishing an ADR agency for IPR began when with a statement signed by nine members of BAM HKI Initiator Team and 15 organizations/ associations dealing with IPR. The minister welcome very well the presence of BAM HKI since even though it only deals with civil law cases, this independent agency would be able to support law enforcement in IPR matters, particularly including Copyright.
 
The same as Copyright Law, several other laws regarding IPR list ADR as an alternative settlement for any civil case emerging. Article 65 of Copyright Law No. 19 of 2002 constitutes that beside proposing an accusation in court, parties having a legal dispute could take an alternative of employing arbitration or ADR. In international level, there is WIPO Mediation and Arbitration Cente/r, owned by the World Intellectual Property Organization.
